Buying THCA flower in bulk before December 11, 2026: the date, state rules and how much to buy
As of 3 October 2026, high-THCA flower can be bought as hemp only until 2026-12-11, and only where state law allows it. On that date (P.L. 119-37 §781; date set by H.R. 6500) the federal hemp test starts counting THCA, and flower above 0.3% total THC becomes marijuana under federal law in every state.
That leaves 69 days. This guide covers what the date means for a bulk buyer, which state rules differ, and how to size an order so you are not holding high-THCA flower on the date.

The federal government is funded only through 2026-12-11 under the same act, so Congress could move the date again (AACOM). Plan for the date as written.
2026-11-12: a narrower date than most summaries say
H.R. 6500 split the dates. Sec. 2019 holds 2026-11-12 only for cannabinoids “not capable of being naturally produced by a Cannabis sativa L. plant” (H.R. 6500, enrolled). THCA flower is not in that group: it follows the 2026-12-11 date (Akerman, 2026-09-02; Foley Hoag, 2026-09-15).
State rules differ
Federal law is the floor. A state can close hemp flower sooner, or test it differently. Our state review, dated 2026-10-03, counts the hemp-retail lane for THCA flower as open in 5 states, open with conditions in 3, contested in 6 and closed in 36 states plus D.C. A few examples of why the count matters:
- Different tests. Florida defines hemp by total delta-9 THC, and its rule adds 0.877 × THCA (Fla. Admin. Code r. 5K-4.034). Wisconsin tests delta-9 “using post-decarboxylation” (Wis. Stat. 94.55). Typical high-THCA flower fails both tests.
- Flower closed at retail. Kentucky allows hemp buds to be sold only to licensed hemp businesses (302 KAR 50:070). Georgia bans retail sale of raw hemp flower (SB 494, 2024). Kansas allows hemp buds to be sold only to licensed processors (K.S.A. 2-3908).
- Earlier dates. Missouri’s HB 2641 makes intoxicating hemp dispensary-only from 2026-11-12 (Missouri Independent). Illinois moves hemp intoxicants into the licensed cannabis system on 2026-11-12 (IL Gov).
States change on short notice. Read your own state’s rule before each order, not once. We accept Order Requests from every US address, and the Operator confirms the rule for your address on the call, before any payment.
How much to buy
The goal is to use what you buy before the date. Work it out from what you actually use:

Two rules keep the plan honest:
- Round down, not up. A half pound now and another later carries less risk than a pound that is still on hand on the date.
- Allow for delivery time. An order confirmed in December spends some of the time left in transit.
Keep the paperwork for every lot
- The COA for the lot, with the client lot number matching the bag label. How to check one is in How to verify a supplier COA.
- The confirmation showing lot, weight, price and date.
- Your arrival record: weight on arrival and condition. The routine is in Buying THCA by the pound.
Ordering several pounds in this store
- Add each lot to the order sheet in half pounds (HP) or pounds (LB). Every buyer pays the listed price.
- Send the Order Request. Nothing is charged online.
- An Operator confirms each line against live lot stock, and agrees delivery and payment by phone. Stock is reserved at confirmation.

After the cutover
Flower that stays within the new hemp definition, no more than 0.3% total THC on a dry-weight basis, remains hemp (CRS IF13136). The store will move its own catalog to compliant products at the Compliance Cutover and will say so on every affected page.

Only what you will use before 2026-12-11. Work it out from what you use per week: grams per week divided by 453.59, times the weeks left. At an ounce a week that is about 0.6 lb from 2026-10-03.
Is the price per pound lower if I buy several pounds?
Not in this store. Every buyer pays the listed HP and LB price, so several pounds cost the LB price times the pounds. A large order is an ordinary Order Request that the Operator confirms by phone.
